Please read these Terms of Use ("Terms") carefully before using the services provided by SiteDreamers ("we," "us," or "our"). By accessing or using our website hosting and development services, you agree to be bound by these Terms. If you do not agree to these Terms, please refrain from using our services.

1. Services and Account Creation:

1.1 Service Description: SiteDreamers provides website hosting and development services. We offer no upfront cost website builds when you subscribe to our premium web hosting service.

1.2 Account Creation: In order to access and use our services, you may need to create an account. You are responsible for providing accurate and up-to-date information during the account creation process. You are also responsible for maintaining the confidentiality of your account credentials and are liable for any activities that occur under your account.

2. Use of Services:

2.1 Acceptable Use: You agree to use our services in compliance with applicable laws and regulations. You shall not use our services for any unlawful or unauthorized purposes, including but not limited to:

• Uploading or transmitting any content that is illegal, harmful, or infringing upon the rights of others.

• Attempting to gain unauthorized access to our systems or networks.

• Interfering with or disrupting the operation of our services.

• Engaging in any activity that could harm our reputation or the integrity of our services.

2.2 Intellectual Property: All intellectual property rights related to our services, including but not limited to trademarks, logos, software, and content, are owned by SiteDreamers or its licensors. You shall not reproduce, modify, distribute, or create derivative works based on our intellectual property without prior written consent from us.

2.3 Third-Party Content: Our services may include content or links to third-party websites. We do not endorse or assume any responsibility for the accuracy, legality, or content of these third-party websites. Your interactions with such third parties are solely at your own risk.

3. Fees and Payment

3.1 Term: This Agreement shall commence on the date of its execution by both parties (the "Effective Date") and continue for a period of twelve (12) months, unless terminated earlier in accordance with the provisions of this Agreement.

3.2 Payment: Client agrees to pay Provider a monthly subscription fee of $179, $229 or $249 for the Services, which includes the items described in Section 1.

3.3 Cancellation: In the event Client wishes to cancel this Agreement before the end of the twelve (12) month term, Client shall pay the remaining balance of the contract outright as a cancellation fee. In addition, should Client request a transfer of their website to another server, Provider shall charge a one-time fee of $250.

4. Privacy: Your privacy is important to us. Our collection, use, and disclosure of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we handle your personal information.
 

5. Limitation of Liability: To the maximum extent permitted by law, SiteDreamers and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or in connection with the use of our services, even if advised of the possibility of such damages.

6. Termination: We may suspend or terminate your access to our services at any time, with or without cause, and without prior notice. Upon termination, all provisions of these Terms that should reasonably survive termination will continue to apply.

7. Changes to the Terms: We reserve the right to modify or update these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website or by other reasonable means. Your continued use of our services after any modifications signify your acceptance of the revised Terms.

8. Governing Law and Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of Pierce County Wisconsin. Any disputes arising out of or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Pierce County Wisconsin.
